New York & New Jersey Drug Charges

Drug charges revolve around the possession, usage, sales, and distribution of controlled dangerous substances. Both New York and New Jersey have classified certain drugs and the compounds used to make them into controlled substance “schedules.” These schedules rank drugs by how dangerous and addictive they are. New York classifies these drugs into five schedules, with Schedule I being the most addictive and likely for abuse.

New York has complex drug laws regarding the various Scheduled drugs and activities relating to them. When it comes to drug possession, for example, carrying of eight ounces or more of a controlled substance in New York is generally charged as a Class A felony which carries penalties of eight to 20 years in prison and/or fines of up to $100,000. Simple possession of marijuana is charged as a violation which can result in up to 15 days in jail or a fine not exceeding $250. Other drug felony charges can range from Class B down to Class E felonies with penalties ranging from up to a year in jail to nine years in prison along with fines between $15,000 and $30,000.
