New York & New Jersey Drug Charges
Drug charges revolve around the possession, usage, sales, and distribution of controlled dangerous substances. Both New York and New Jersey have classified certain drugs and the compounds used to make them into controlled substance “schedules.” These schedules rank drugs by how dangerous and addictive they are. New York classifies these drugs into five schedules, with Schedule I being the most addictive and likely for abuse.

Medical drugs such as oxycodone, hydrocodone, Xanax, Valium, and more are also listed in New York and New Jersey schedules. Possession and distribution of these drugs without a valid prescription are also prohibited by law. While other states have legalized the recreational use of marijuana, possession and sale of this substance remains a criminal offense in both states as of 2020.
How you are punished in any drug crime will depend on what the schedule of the drug that was found in your possession, how much of it was found, and whether your crime involved selling, distributing, manufacturing, or trafficking. New York has complex drug laws regarding the various Scheduled drugs and activities relating to them. However, all crimes involving the sale of controlled substances in the state are charged as felonies ranging from the lowest fifth-degree level to the most serious first-degree felonies.
When it comes to drug possession, for example, carrying of eight ounces or more of a controlled substance in New York is generally charged as a Class A felony which carries penalties of eight to 20 years in prison and/or fines of up to $100,000. Simple possession of marijuana is charged as a violation which can result in up to 15 days in jail or a fine not exceeding $250. Other drug felony charges can range from Class B down to Class E felonies with penalties ranging from up to a year in jail to nine years in prison along with fines between $15,000 and $30,000.
