Sex Crimes in New York

Sex crimes generally involve subjecting another person to some type of sexual behavior against his or her will. New York has many laws criminalizing specific types of sexual misconduct which can range from lower level misdemeanor charges to felony crimes with long-term prison sentences and mandatory sex offender registration for 20 years or more. How you are charged and what type of punishment results will depend on the nature of the alleged offense, whether minors were involved, whether serious injury occurred, and other pertinent facts.

For example, under Penal Code Sections 130.52 – 130.70 sexual abuse in the first degree occurs when some type of contact that is sexual in nature occurs where physical force or violence is used against the victim, when the victim cannot consent due to being rendered helpless, when the victim is a child under the age of 11, or when the victim is less than 13 years old and the defendant is 21 or older. This type of offense is not rape or any type of penetration. It is still charged as a felony that can result in up to seven years in prison, fines, and mandatory sex offender registration.

A more serious sex offense is rape which can be charged as a Class B felony punishable by five to 25 years in prison, fines of up to $5,000, and sex offender registration. It involves sexual intercourse with another using physical force and against the other person’s will.
