DUI/DWI Defined

It is a crime for a driver to operate a vehicle while impaired by the effects of drugs or alcohol. If you are arrested and prosecuted for a DWI, you may be subject to criminal conviction, jail, have you driver’s license suspended, pay heavy fines, have your vehicle impounded or forfeited, an ignition interlock device put on your car, and suffer other consequences.

As a rule, after an arrest for a DWI your license is suspended the very first time you go to court, though conviction hasn’t yet resulted.

DWI or DUI convictions can also result in your having a permanent criminal record, and possibly cause the loss of your job or future employment. If you are a commercial driver, you could lose your privilege to drive commercially for at least one year.

These convictions are very serious, and will go on your record.

Additional Information

If you are pulled over by the police for drunk driving they will probably request you take a breathalyzer or some chemical test to determine the amount of alcohol in your blood. You do not have to take this test.

You may suffer the suspension of your license for “refusing” the test, but by not taking it, you won't be providing conclusive, scientific evidence against yourself. The police case against you is substantially weaker without breathalyzer or chemical test results. You do not have to answer police questions, speak, sign or initial anything if you are detained by the police for suspicion of DUI/DWI.
